New York: Further Infringements Avoided as Session Comes to an End

Legislators concluded the 2016 Legislative Session last weekend as Friday, June 17, turned into Saturday morning in Albany.  Lawmakers typically force a long list of bills through the process in a short amount of time in the waning hours of session, and this is the time of year to be hyper-vigilant.  Like the SAFE Act, much of this legislation goes through in the middle of the night with little or no public input or attention. As the frenzied end of session came to a close, your NRA-ILA is happy to report that gun owners were spared this session from additional damage.  Despite the fact that anti-gun politicians secured one of the toughest gun control laws in the country with the passage of the SAFE Act in 2013, they will never be completely satisfied until guns are completely banned in the Empire State.  The dozens of anti-gun bills introduced this year are proof of that.  Groups like New Yorkers Against Gun Violence unbelievably claim there aren’t enough gun control laws, and they continue to push for more restrictions on your Second Amendment rights. The 2016 session had no shortage of gun control bills.  Three bills headlined the push from anti-gun groups in Albany, and NRA vigorously fought these bills, in addition to others.  S.2050A, sponsored by state Senator Daniel Squadron, would have banned .50 Caliber rifles, even though this firearm is virtually never used in the commission of a crime.  Bill sponsors certainly can’t point to an example in New York.  Fortunately, the bill did not move and failed to clear the Senate Codes Committee.  Legislation requiring mandatory storage of firearms was... read more

Let’s get this straight from the start, I support Donald Trump for President of the United States.

Come Together Let’s get this straight from the start, I support Donald Trump for President of the United States. That was not so one year ago when I supported Mike Huckabee because of how and what he said at the NRA Annual Meetings in Nashville. At this point in time no matter what the pundits are saying Mr. Trump is our last best hope to defeat Hillary Clinton. Think about this for a moment; millions more people voted for Mr. Trump than any other Republican candidate, he brought thousands if not millions of new voters to the party and through thick and thin they stayed with him. Loyalty is a scarce commodity these days but his supporters have it. But all that said there is a more important aspect of this election to be considered. We must support whoever is chosen as the Republican candidate for President and it doesn’t matter that I think Trump is the best man for the job and that I will be working toward that goal. The most important goal of this election cycle is to elect a Republican President. Why? Members and Supporters: After three years of continued movement through the Judicial System the death of Justice Antonin Scalia accomplished a feat the anti-gunners were unable to do; it stopped our lawsuit. Below please find a statement Jay Porter a Constitutional Lawyer very much involved in NYSRPA V Cuomo and many other Constitutional issues prepared the statement below. If you have any questions please forward them to Mr. Porter at jporter@babc.com Ten or so days ago, all those who cherish the freedoms guaranteed by the Second Amendment suffered a tremendous loss with the passing of Justice Antonin Scalia. Justice Scalia was the author of the Heller decision and was a staunch defender of the right to keep and bear arms. Unfortunately, with his passing, it is likely that there are, at most, only four justices committed to a proper understanding of the Second Amendment. Given what we know or believe about the current makeup of the Supreme Court, the best case scenario would be a 4-4 decision, which would result in the Second Circuit’s decision being affirmed. Accordingly, at present, there is no chance of reversing the Second Circuit’s decision upholding New York’s gun ban on safety enhancing features and life-saving standard capacity magazines. There is, however, a very great risk that, in the absence of Justice Scalia’s influence, a majority could in fact vote to affirm the Second Circuit case, which would result in binding Supreme Court precedent and create a potentially insurmountable obstacle to the practice and enjoyment of those rights elucidated in the Heller decision. The quote below is from the decision rendered in the Maryland AW suit a few days ago. This to most Constitutional Lawyers is one of the most important statements in the decision. The ruling will make it easier for NYSRPA v Cuomo to reach the Supreme Court.         “In our view, Maryland law implicates the core protection of the Second Amendment — ‘the right of law-abiding responsible citizens to use arms in defense of hearth and home,’ District of Columbia v. Heller, 554 U.S. 570, 635 (2008), and we are compelled by Heller and McDonald v. City of Chicago, 561 U.S. 742 (2010), as well as our own precedent in the wake of these decisions, to conclude that the burden is substantial and strict scrutiny is the applicable standard of review for Plaintiffs’ Second Amendment claim.”     In other words, though other appeals courts have failed to uphold the Constitution, the Fourth Circuit says the Maryland ban clearly violates the Second Amendment, and the lower court needs to figure that out. RE: NYSRPA v Cuomo: PARTIAL VICTORY, FIGHT CONTINUES TO THE SUPREME COURT!!!!

Second circuit court of appeals decision – NYSRPA vs. Cuomo Ladies and Gentlemen, The 2nd Circuit Court of Appeals has just released their decision on the SAFE Act legislation and it has resulted in the first permanent non legislative change. The Court upheld Judge Skretney’s decision that seven round magazine limit was an arbitrary number and unconstitutional but also upheld the State’s Assault Weapon ban. It’s a great victory for the Gun Owners of New York State and the final step on our way to the U.S. Supreme Court. We want to thank NYSRPA Members, the National Rifle Association, the Gun Owners of New York State and everyone else who supports The New York State Rifle & Pistol Association’s effort to defend the Constitution of the United States and the Right to Keep and Bear Arms of all citizens.
