Lawsuits

On June 23, 2022, the New York State Rifle and Pistol Association won their Landmark Case in the Supreme Court with a 6-3 decision, the majority ruled that New York’s law was unconstitutional, and ruled that the ability to carry a pistol in public was a constitutional right under the Second Amendment, being the most significant case in more than a decade! Decades of Right-to-Carry laws across America have proven that good men and women are not the problem. This was a monumental win for NYSRPA and gun owners across the country. And then Governor Kathy Hochul thumbed her nose at the Supreme Court and passed more egregious laws assaulting gun owners, law-abiding citizens, treating them as criminals further imposing on their god-given rights.

Our new lawsuit Bruen 2 is awaiting a Judge and date. Currently, the Second Circuit Court of Appeals has 4 cases in which they have yet to decide, once that is done, we can get movement on our new case. If you would like to read the case, you can find it here: https://www.nysrpa.org/nysrpa-vbruen2update/

The NRA was a party in the New York Rifle & Pistol Association v. Bruen on October 2nd 2023 a NYS Judge orders New York to pay the NRA $447,000 in legal fees, NRA states that this is a symbol that justice is definitively on our side, you can read the whole article here: Judge orders New York to dole out nearly half a million in legal fees to NRA after Supreme Court victory | Fox News

Pistol Permit Recertification

In 2017 New York State passed a law stating that you would have to recertify your pistol permit every five years, this last law in September changed the recertification rules. If a pistol Permit holder were to fail to re-new and re-certify their eligibility to possess a pistol license, that permit holder could be charged with at least one Class A misdemeanor, punishable by up to one year of incarceration. Please make sure you are reading the law and abiding by it, the state will not accept that you were not aware of local law as an excuse. Please go to https://gunsafety.ny.gov/pistol-permitrecertification and check on when you need to recertify, even if you just did it a year ago GO CHECK OUT WHAT THE NEW DATE IS!!

On behalf of all the members of NYSRPA across New York and the US, I would like to express my appreciation to our Legal team. Without the support of our members and the NRA, the financial burden our state has forced upon us with the egregious laws would have been crippling. Keep up the good fight New York!
