Ladies and Gentlemen,
The judge hearing the above case in the Northern District of the 2nd Circuit Court of Appeals has filed his decision in our case referenced above. His decision essentially said our case has no merit so he is ruling for the defendants and New York State.
This ruling is not a surprise and in fact allows us to move forward to appeal to the full 2nd Circuit and if needed eventually on to the Supreme Court of the United States. The appeal to the full court is being prepared as you read this and will be tentatively filed on Januayr 16, 2019.
